DFLA Files Amicus Brief

Democrats For Life of America (DFLA) has filed amicus curiae (friend of the court) briefs in three federal court cases in support  of the conscience clause of  individuals and organizations who oppose parts of the US Department of Health and Human Services (HHS) mandate  that  requires  individuals to facilitate abortions through their employees’ health insurance coverage.

Administration Offers Compromise on Contraception Mandate

We are pleased to see that the Administration issued a proposed rule to address our concerns with the Contraception Mandate.  We are currently reviewing the proposal and will have a more in-depth analysis soon.

Dear Ms. Tavenner:
 
On behalf of the Democrats for Life of America (DFLA), we respectfully submit the following comments on the Advance Notice of Proposed Rulemaking (“ANPRM”) on preventive services. 77 Fed. Reg. 16501 (Mar. 21, 2012).  The ANPRM expresses the Administration’s intention to propose additional regulations, in order to establish “alternative ways” of “ensuring contraceptive coverage for plan participants and beneficiaries” enrolled in plans offered by non-exempt “religious organizations” that object to such coverage while, at the same time, “accommodating such organizations.”  Id. at 16501.
 
Introduction and Summary of Points
 
Democrats for Life of America (DFLA) is the preeminent national organization for pro-life Democrats.  We believe that the protection of human life is the foundation of human rights, authentic freedom, and good government.  These beliefs animate our opposition to abortion, euthanasia, capital punishment, embryonic stem cell research, poverty, genocide, and all other injustices that directly and indirectly threaten human life.  As pro-life Democrats, we share the party’s historic commitments to supporting women and children, strengthening families and communities, and striving to ensure the equality of opportunity, a reduction in poverty, and the existence of an effective social safety net that guarantees that all people have sufficient access to food, shelter, healthcare, and life’s other basic necessities.

Dear President Obama,

On behalf of pro-life Democrats around this nation, I am writing to express our deep concern about the Administration’s failure to give meaningful protection to religious conscience with respect to the mandated contraception coverage under the Affordable Care Act (ACA).  We urge the Administration to extend the accommodation to religious social- service, educational, and healthcare institutions that would have to violate their religious tenets to abide by the mandate.

Two and a half years ago, I sat in a small storage room on the fourth floor of the Cannon Building to begin negotiations between the Obama Administration and a group of Pro-Life Democratic Members of Congress.  These Democratic Members, myself included, formed a small handful of critical votes necessary to secure passage of the Patient Protection and Affordable Care Act, National Health Care legislation.

These negotiations took place without the glare and scrutiny of the national media.  No staff members were present, and discussions were honest, frank, and respectful.  These negotiations, held several times throughout the weekend, resulted in Executive Order 13535, signed by President Obama, and upheld the principles contained in the 40 year old Hyde Amendment which prohibits the use of taxpayer dollars to fund abortions.  The Executive Order also reaffirmed the “conscience clause” which states that no person or institution can be forced to accept, provide or comply with health care policies or medical procedures contrary to their religious and moral beliefs.

Measure Steers Women to Clinics

Pro-life Democrats enthusiastically greeted the many progressive components in the Women's Equality Act described by Gov. Andrew Cuomo in his State of the State address, in areas such as family status discrimination, workplace sexual harassment and human trafficking. We were dismayed, however, at his inclusion of extremist measures that would promote abortion while repealing some existing protections for pregnant women.
